Terms of Service

Beloved Songs (“Beloved Songs,” “we,” “us,” or “our”) is a custom songwriting service. We turn the stories, memories, and details you share with us into an original, professionally produced song created by a real team of songwriters, vocalists, and audio engineers.

These Terms form a legally binding agreement between you and Beloved Songs. They work together with our Privacy Policy, which explains how we handle the information you share with us.

You must be at least 18 years old, or the age of majority in your jurisdiction, to place an order or enter into these Terms. If you use the Services on behalf of another person or an organization, you represent that you are authorized to accept these Terms on their behalf.

By using the Services, you represent and warrant that all information you provide is accurate, that you have the right to share it, and that your use of the Services complies with all applicable laws.

When you place an order, you complete a guided questionnaire describing the person the song is for, your relationship, memories, milestones, the mood and genre you want, and any other details you choose to share. Our songwriters use those details to write original lyrics and produce a recorded song.

Each finished order typically includes the following, except where a specific order page states otherwise:

• One original song, generally between 2.5 and 4 minutes in length, written from scratch based on the information you provide.
• Real human vocals and instrumentation, recorded and mixed in a studio. We do not use AI-generated vocals.
• Custom lyrics incorporating the names, memories, and details you submit.
• Delivery in your selected genre and mood, subject to creative interpretation by our songwriting team.
• A private link to stream and download your song in MP3 format.

Songwriting is a creative process. While we work hard to honor your wishes, the specific melody, arrangement, vocal performance, lyrical phrasing, and overall artistic interpretation are made at the discretion of our creative team. The final song may differ from any examples, samples, or descriptions you have seen.

Prices for the Services are shown at checkout and are stated in U.S. dollars unless otherwise indicated. You are responsible for any applicable taxes, fees, or currency-conversion charges.

Payment is due in full at the time you place your order. By submitting payment information, you represent that you are authorized to use the payment method and you authorize us, through our third-party payment processor, to charge the full order amount. We do not store full payment-card numbers ourselves.

We may, at our discretion, refuse or cancel any order, including for suspected fraud, payment issues, errors in pricing or product descriptions, or content that violates these Terms. If we cancel an order before work has begun, we will refund any amount you paid for that order.

An order is considered placed once payment is received and you have submitted your questionnaire responses. We begin creative work based on the information available to us at that time.

From time to time we offer promotional codes, seasonal sales, and discounts. Unless stated otherwise, promotional offers cannot be combined, have no cash value, apply only to qualifying orders, and may be changed or withdrawn at any time before an order is placed. Promotional pricing does not change your rights under our money-back guarantee.

Standard orders are typically delivered within 7 days. A 24-hour rush option may be available at checkout for an additional fee. Delivery timelines begin once we have received your completed questionnaire and full payment.

Delivery estimates are good-faith targets, not guarantees, and may be affected by the completeness of the information you provide, the volume of revision requests, or circumstances beyond our reasonable control. If you need your song by a specific date, please tell us when you order. If we believe we cannot meet a stated deadline, we will let you know before you are charged whenever possible, and you may cancel for a full refund in that situation.

Delays caused by incomplete, unclear, or late questionnaire responses, or by your delay in responding to questions from our team, are not our responsibility and do not entitle you to a refund on the basis of timing alone.

“Your Content” means everything you submit to us: questionnaire answers, names, memories, photos, voice notes, reference tracks, messages, and any other materials. You retain ownership of Your Content.

By submitting Your Content, you grant Beloved Songs a worldwide, non-exclusive, royalty-free license to use, reproduce, store, adapt, and incorporate it solely for the purpose of creating, producing, delivering, and supporting your song and the Services.

You represent and warrant that:

• You own or have all necessary rights and permissions to submit Your Content and to grant the license above.
• Your Content does not infringe the intellectual property, privacy, or publicity rights of any person.
• If Your Content includes information about a third party (including the song's recipient), you have the right to share that information for the purpose of creating the song.
• Your Content is not unlawful, defamatory, hateful, harassing, sexually explicit involving minors, or otherwise in violation of these Terms.

We are not obligated to review Your Content, but we may decline or remove any content, or cancel any order, that we believe violates these Terms or applicable law.

Beloved Songs and its songwriters retain ownership of the musical composition, sound recording, lyrics, master files, and underlying intellectual property of the song we create for you, including the copyright in the recording.

Upon full payment and final delivery, we grant you a perpetual, worldwide, non-transferable, non-exclusive license to use, stream, download, copy, and privately share your song for personal, non-commercial purposes. This includes playing it at personal events such as weddings, birthdays, anniversaries, and memorials, and sharing it on your personal social media accounts.

This license does not permit you to:

• Sell, license, sublicense, or otherwise commercially exploit the song.
• Distribute the song on commercial streaming platforms or stores, or monetize it in any way (including ad revenue).
• Use the song in advertising, promotional, or branded content for any business.
• Claim authorship of the composition or recording, or register it with a performing-rights organization or content-identification system.
• Create derivative works from the song, or remix, sample, or re-record it, without our written permission.

If you would like rights beyond personal use, contact us to discuss a separate commercial license. Beloved Songs may use anonymized or excerpted song samples for our own portfolio, marketing, and promotional purposes; if you would prefer we not feature your song, let us know and we will honor that request.

We want you to love your song. If something feels off, you may request a revision. Unless your order page states otherwise, each order includes at least one free revision addressing lyrical accuracy, mood, or production notes.

Revision requests should be specific and submitted within a reasonable time after delivery. Revisions are intended to refine the song based on your original questionnaire, not to commission a substantially different song, change the genre or recipient, or rewrite the song from scratch. Significant changes outside the scope of the original brief may require a new order or an additional fee.

We stand behind our work with a 45-day money-back guarantee. If you are not happy with your song, we will first offer a free revision. If you still do not love it, you may request a full refund within 45 days of delivery.

To request a refund, contact us at hello@belovedsongs.com within the 45-day window and let us know that the song did not meet your expectations. Refunds are issued to your original payment method.

The guarantee is offered in good faith and does not cover:

• Requests made more than 45 days after delivery.
• Dissatisfaction caused by inaccurate, incomplete, or misleading information you provided in your questionnaire.
• Abuse of the guarantee, such as requesting a refund after using the song at the event it was created for, or repeated refund requests across multiple orders.
• Add-on fees that have already been fully performed, where separately noted at checkout.

If we issue a refund, the license granted to you in Section 8 terminates and you must stop using and delete all copies of the song.

You agree not to use the Services to request, create, or distribute content that:

• Harasses, threatens, defames, or invades the privacy of any person.
• Is hateful or discriminatory, or promotes violence against any individual or group.
• Is sexually explicit, or sexualizes a minor in any way.
• Infringes anyone's intellectual property, privacy, or publicity rights.
• Is intended to deceive, defraud, impersonate, or mislead.
• Violates any applicable law or regulation.

You also agree not to interfere with or disrupt the Services, attempt to gain unauthorized access to our systems, scrape or copy the site, or use the Services to build a competing product. We may suspend or terminate access, and cancel orders, for any violation of this section.

Our songs are written, performed, and produced by real people. We do not use AI-generated vocals. We may use standard studio software and production tools in the course of creating and mixing your song. Our songwriting team works as independent professionals, and the specific person assigned to your song is at our discretion.

The Services rely on third parties such as payment processors, hosting providers, email delivery services, and analytics tools. Your use of those services may be subject to their own terms and policies. We are not responsible for the acts or omissions of third parties, and links to third-party websites are provided for convenience only.

The Services are provided “as is” and “as available.” To the fullest extent permitted by law, Beloved Songs disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that the Services will be uninterrupted, error-free, or secure, that any defects will be corrected, or that the creative outcome of any song will meet your subjective expectations. Songwriting is inherently subjective, and your sole remedy for dissatisfaction is the revision and refund process described in these Terms.

To the fullest extent permitted by law, Beloved Songs and its owners, employees, contractors, and partners will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or emotional distress, arising out of or relating to the Services, even if we have been advised of the possibility of such damages.

Our total aggregate liability for any claim arising out of or relating to the Services or these Terms will not exceed the amount you paid to us for the order giving rise to the claim. Some jurisdictions do not allow certain limitations, so some of these limitations may not apply to you.

You agree to indemnify and hold harmless Beloved Songs and its owners, employees, contractors, and partners from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to Your Content, your use of the Services, your violation of these Terms, or your violation of any law or the rights of any third party.

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules. Before filing any formal claim, you agree to first contact us at hello@belovedsongs.com so we can try to resolve the issue informally.

If we cannot resolve a dispute informally, you agree that any dispute arising out of or relating to these Terms or the Services will be resolved on an individual basis, and not as part of a class or representative action, to the extent permitted by applicable law. Nothing in these Terms limits any non-waivable statutory rights you may have as a consumer.

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Material changes will take effect on the date posted, and your continued use of the Services after that date constitutes acceptance of the updated Terms. Orders are governed by the Terms in effect at the time the order was placed.

We may suspend or terminate your access to the Services at any time if you violate these Terms or if we discontinue the Services. Sections that by their nature should survive termination — including content licenses, ownership, disclaimers, limitations of liability, and indemnification — will continue to apply.
